Hello,
I am not clearly understanding the question.
If you tell the person you are selling it to, or mailing it to, that it is broken then you are all set; just sell it as “parts” or “as is”.
If you are asking if you just sell the controller to a shop, will they realize it is broken then, I think they would because they will probably test it on another xbox before they buy it.
